Terms and conditions

The terms and conditions, together with your order confirmed through an order confirmation, constitute the complete contractual basis for the purchase. These provisions apply as a binding contract for goods/services purchased via alpinco.com, through our call center, directly from an agent, etc., and for stays at our rental units and Gudbrandsgard Hotel. Consumer purchases are regulated, among others, by the Consumer Purchases Act, the Right of Withdrawal Act, the Marketing Control Act, the Personal Data Act, the E-Commerce Act, and the Credit Purchases Act.

1 ALPINCO AS – TERMS AND CONDITIONS FOR THE PURCHASE OF LIFT PASSES

1.1 General

These terms and conditions, together with your confirmed booking, form the contractual basis for your purchase of lift passes at one of Alpinco AS’s (Alpinco) ski and bike destinations, Hafjell, Kvitfjell, or Oppdal (“Destinations”).

1.2 Booking and Payment

1.2.1 Completion of Booking

All bookings of lift passes are made via Alpinco’s website www.alpinco.no, or at vending machines at one of Alpinco’s destinations.

All Alpinco destinations use a contactless lift pass solution (Axess). If you already have an Axess card, it can be reused by entering the card number when ordering a new lift pass. All lift passes must be activated at the destination where the purchase was registered.

The purchaser of the lift pass (the “Purchaser”) must be at least 18 years old at the time of booking.

1.2.2 Binding Effect of Booking

The booking becomes binding for the parties as soon as the Purchaser has received a booking confirmation and has paid in accordance with section 1.2.3. For bookings with deferred payment deadlines, the booking becomes binding even if payment has not been completed.

1.2.3 Payment

The Purchaser is obliged to pay the agreed price for the lift pass upon completion of the booking via Alpinco’s website, via vending machine, or within the deadline specified in Alpinco’s booking confirmation.

Several payment services are available at Alpinco’s destinations. By paying, the Purchaser accepts the terms of the applicable payment service.

Transaction costs for international payments shall be borne by the Purchaser.

1.2.4 Delayed Payment

For lift pass bookings with a deferred payment deadline, the booking becomes binding once the Purchaser has received confirmation. If payment is not made within the deadline, the booking will be cancelled. The Purchaser’s payment obligation in such cases of cancellation is governed by section 1.4.

1.3 Prices

Alpinco is responsible for delivering lift passes at the prices stated on its website, in vending machines, in special offers, or in other informational/marketing materials issued by Alpinco. Alpinco’s prices are dynamic and may change based on supply and demand.

Lift pass prices vary by the following age groups:

  • Children (0–6 years), free when wearing a helmet (cost of Axess card applies).
  • Children/Youth (7–17 years)
  • Adult (18–64 years)
  • Senior (65+ years)

The age at the time of booking determines the age group into which the lift pass user falls.

Alpinco reserves the right for typographical errors and, in such cases, may adjust the booking to the correct price. Alpinco also reserves the right to adjust prices due to increased costs for goods and services, higher taxes and fees, and/or other circumstances beyond Alpinco’s control.

Such adjustments are conditional on Alpinco notifying the Purchaser of the corrected price before the lift pass(es) are used.

1.4 Cancellation/Changes

Pre-booked lift passes may be cancelled or changed up to 10 days before the validity date. Within this period, the validity date and/or period of the lift pass may also be changed.

If the validity date is changed within the deadline, prices may also be adjusted to the applicable prices at the time of the change. This applies even if the pass was purchased at a discount or during a promotional campaign.

After the deadline, the right to cancel or change lapses, and the Purchaser is liable to pay the purchase amount stated in the booking confirmation, regardless of whether the lift pass is used.

If the purchase was made with a deferred payment deadline, and the payment is due earlier than 10 days before the validity date, failure to pay within the deadline will be regarded as a cancellation releasing the Purchaser from the obligation to pay. Such cancellation will occur automatically the day after the due date. Any new booking by the Purchaser will be subject to these terms, the applicable prices, and destination capacity at the time.

If the payment deadline is later than 10 days before the validity date, failure to pay will be deemed an unauthorized cancellation that does not release the Purchaser from the obligation to pay.

1.5 Right of Withdrawal

Consumers who purchase lift passes via distance selling or outside Alpinco’s permanent business premises (including vending machines) have a right of withdrawal pursuant to the Norwegian Right of Withdrawal Act. The right of withdrawal does not apply to anyone other than consumers.

A consumer wishing to exercise the right of withdrawal must do so within fourteen (14) days after the purchase is completed. Use of the right of withdrawal must be done by completing this form (insert hyperlink). The form is also available on Alpinco’s website.

The withdrawal form should be sent to (insert email address).

The consumer shall bear the cost of returning the lift pass, if applicable.

If the lift pass has been used before exercising the right of withdrawal, the consumer must still pay reasonable costs, including, but not limited to, the cost of the lift pass for the period used, cf. Right of Withdrawal Act § 26.

The right of withdrawal does not apply to the purchase of package travel.

2 ALPINCO AS – TERMS AND CONDITIONS FOR SKI AND BIKE RENTALS

2.1 General

These terms and conditions, together with your confirmed booking, form the contractual basis for your rental of ski and bike equipment (“Equipment”) at one of Alpinco AS’s (Alpinco) ski and bike destinations, Hafjell, Kvitfjell, or Oppdal (“Destinations”).

All rental of Equipment at Alpinco’s Destinations is operated by third parties (“Rental Provider”), and Alpinco acts solely as an intermediary of these third-party rental services. These terms and conditions apply to the relationship between you (the “Renter”) and the relevant Rental Provider.

2.2 Booking and Payment

2.2.1 Completion of Booking

All bookings of Equipment are made via Alpinco’s website www.alpinco.no, or directly in the Rental Provider’s store at one of Alpinco’s Destinations.

The Renter must be at least 18 years of age at the time of booking.

2.2.2 Binding Effect of Booking

The booking becomes binding for the parties as soon as the Renter has received a booking confirmation and has paid in accordance with section 2.2.3. For bookings with deferred payment deadlines, the booking becomes binding even if payment has not been completed.

2.2.3 Payment

The Renter is obliged to pay the agreed price for the rental of Equipment upon completion of the booking via Alpinco’s website, within the deadline specified in the booking confirmation, or at the time of collection of the Equipment, depending on what is stated in the booking confirmation.

Several payment services are available at Alpinco’s Destinations. By paying, the Renter accepts the terms of the applicable payment service.

Transaction costs for international payments shall be borne by the Renter.

2.2.4 Delayed Payment

For bookings of Equipment with deferred payment deadlines, the booking becomes binding as soon as the Renter has received a booking confirmation. If payment is not made within the deadline, the booking will be cancelled. The Renter’s payment obligation in such cases of cancellation is governed by section 2.5.

2.3 Prices

The Rental Provider is responsible for delivering Equipment at the prices stated on their website, on Alpinco’s website, in special offers, or in other informational/marketing materials issued by the Rental Provider or Alpinco.

The Rental Provider reserves the right for typographical errors and, in such cases, may adjust the booking to the correct price. The Rental Provider also reserves the right to adjust prices due to increased costs for goods and services, higher taxes and fees, and/or other circumstances beyond their control.

Such adjustments are conditional on the Rental Provider notifying the Renter of the corrected price before the Equipment is collected and used.

2.4 Equipment Insurance / Coverage

When renting Equipment, the Renter must purchase insurance/coverage for potential damages to the Equipment. One coverage applies per booking. Such coverage does not include damages caused by use outside marked trails or theft.

2.5 Cancellation/Changes

For cancellations up to 7 days before the first rental day, a cancellation fee of NOK 300 per booking will apply.

For cancellations later than 7 days before, but up to one day before the first rental day, a fee of NOK 300 plus 50% of the rental cost will apply.

The Renter is not entitled to cancel the rental on the first rental day. In such cases, the Renter is obliged to pay the full rental amount.

If the booking was made with a deferred payment deadline, and the payment is due earlier than 7 days before the first rental day, failure to pay will be regarded as a cancellation releasing the Renter from the obligation to pay, except for the cancellation fee of NOK 300.

Such cancellation will occur automatically the day after the due date. Any new booking by the Renter will be subject to these terms, the applicable prices, and the Rental Provider’s capacity at the time.

If the payment deadline is later than 7 days before, and up to one day before the first rental day, failure to pay will obligate the Renter to pay 50% of the rental cost plus the cancellation fee of NOK 300.

2.6 Right of Withdrawal

Rental of Equipment is a service related to leisure activities, scheduled for a specific date or period. Such purchases do not entitle the Renter to a right of withdrawal, cf. Right of Withdrawal Act § 22, first paragraph, letter m.

2.7 Rental Provider’s Delivery of Equipment

The Rental Provider is responsible for delivering the booked Equipment on time.

The Equipment delivered may differ from pictures. The Rental Provider is not obliged to deliver the exact model depicted on Alpinco’s website, in special offers, or in other materials issued by the Rental Provider or Alpinco. The contractual obligation is fulfilled if the Rental Provider delivers Equipment suitable for the same purpose, for the same skill level, and of similar quality.

The Equipment shall be in good condition, and the Rental Provider regularly replaces all Equipment. The Renter must nevertheless expect that the Equipment may appear well-used and bear marks/scratches.

2.8 Renter’s Responsibility

2.8.1 Identification

When collecting the Equipment, the Renter must present valid photo identification. If valid identification cannot be presented, the Renter has no right to receive the Equipment. In such cases, the Renter shall be deemed to have cancelled the booking in accordance with section 2.5.

2.8.2 Travel Insurance

Alpine skiing and biking are activities with an increased risk of injury, both personal and material. The Renter must ensure that they have taken out travel insurance covering any injuries that may occur during the use of the Equipment.

2.8.3 Inspection of Equipment before Use

Upon delivery, the Renter must inspect all Equipment and approve it before taking it over. If the Renter discovers any damage, this must be reported to the Rental Provider before use.

2.8.4 Liability for Damage and Theft

During the rental period, the Renter is responsible for the Equipment. Ski and bike equipment can easily be mixed up, and the Renter is encouraged to take a photo of the Equipment and barcode for identification.

The Renter must compensate for any damage to the Equipment that occurs during the rental period.

The Renter must also ensure that the Equipment is never left unattended but always locked or supervised when not in use. The Renter is liable for stolen Equipment and must reimburse the Rental Provider’s cost of replacing the Equipment.

2.8.5 Use of Equipment and Compliance with Safety Regulations

The Renter is responsible for adapting speed and conduct according to their abilities, and ensuring that all use occurs in a manner that does not endanger the Renter or others.

The Renter is responsible for using the Equipment in accordance with applicable safety rules for alpine skiing, including the alpine safety rules (https://alpinogfjell.no/alpinvettreglene) and the rules/instructions in effect at the Destination.

Breach of this duty of care may result in liability for damages to the Rental Provider, Alpinco, or others who suffer damage as a result of the Renter’s conduct.

The Renter must also be aware of opening and closing hours, open and closed slopes, and comply with all signage or instructions given by Alpinco personnel.

Use of the Equipment outside the marked slopes of the facility is not permitted.

NOTE! Alpinco specifically warns that any activity in the facility after closing time is prohibited and may expose you to serious danger.

After closing, slope grooming is carried out with heavy grooming machines, and winches are used to pull the machines up steep sections. Do not assume you will detect grooming machines or winches in time to avoid them. Overhangs can conceal machines. Winches are particularly difficult to see, especially at night. A winch cable may also lie hidden in the snow and move with great force when tightened.

2.8.6 Return of Equipment

The Renter is obliged to return the Equipment within the agreed time.

Return shall take place at one of the Rental Provider’s outlets at the Destination.

If the Rental Provider must collect the Equipment from another location, the Renter must pay a collection fee of NOK 500 per Equipment package. An Equipment package refers to equipment for one person.

2.9 Refund

2.9.1 General

Alpinco strives at all times to deliver the best possible experience at its Destinations. Skiing and biking are outdoor activities, and the services offered (lifts and slopes) will vary depending on the season, weather and surface conditions, and technical operations. Renters must expect that not all lifts and/or slopes are open at all times, without this constituting a breach of contract by the Rental Provider or Alpinco.

2.9.2 Weather and Conditions

Mountain weather is changeable, and the Rental Provider provides no refund for Equipment rental due to bad weather, fog, snow, icing, melting, flooding, or similar. The Renter is responsible for staying informed of the current weather forecast for the Destination and assessing whether their skills are sufficient for the prevailing conditions.

2.9.3 Competitions and Training

At Alpinco’s Destinations, regular training and competitions at all levels are held. During such events, parts of the ski and bike slopes may be closed to the public and reserved for participants and staff.

Such restrictions may be extensive, especially during World Cup events, without constituting a breach of contract by the Rental Provider or Alpinco.

2.9.4 Operational Interruptions

The Rental Provider does not refund rental costs in the event of operational interruptions at the facility.

2.9.5 Early Return of Equipment

The Rental Provider does not refund rental costs if Equipment is returned before the agreed rental period ends.

2.10 Personal Data

Alpinco values your privacy and processes all personal data in accordance with applicable legislation. For more information on how we process personal data, please see our Privacy Policy, which is described in section 7 of this document.

2.11 Dispute Resolution

If you have a complaint, please contact the Rental Provider directly. If no agreement is reached, the dispute may be brought before the courts.

This agreement is governed by Norwegian law, with venue in the judicial district where the relevant Destination is located.

3 ALPINCO AS – TERMS AND CONDITIONS FOR SKI SCHOOL

3.1 General

These terms and conditions, together with your confirmed booking, form the contractual basis for your booking of ski school/ski instruction at one of Alpinco AS’s (Alpinco) ski destinations, Hafjell, Kvitfjell, or Oppdal (“Destinations”).

All ski school/ski instruction (“Ski Course”) at Alpinco’s Destinations is operated by third parties (“Ski School”), and Alpinco acts solely as an intermediary of these services. These terms and conditions apply to the relationship between you and the relevant Ski School.

3.2 Booking and Payment

3.2.1 Completion of Booking

All bookings of Ski Courses are made via Alpinco’s website www.alpinco.no, or directly at the Ski School’s premises at one of Alpinco’s Destinations.

The person booking a Ski Course (the “Purchaser”) must be at least 18 years of age at the time of booking.

3.2.2 Binding Effect of Booking

The booking becomes binding for the parties as soon as the Purchaser has received a booking confirmation and has paid in accordance with section 3.2.3. For bookings with deferred payment deadlines, the booking becomes binding even if payment has not been completed.

3.2.3 Payment

The Purchaser is obliged to pay the agreed price upon completion of the booking via Alpinco’s website or directly at the Ski School, within the deadline specified in the booking confirmation, or before the start of the Ski Course, depending on what is stated in the confirmation.

Several payment services are available at Alpinco’s Destinations. By paying, the Purchaser accepts the terms of the applicable payment service.

Transaction costs for international payments shall be borne by the Purchaser.

3.2.4 Delayed Payment

For bookings of Ski Courses with deferred payment deadlines, the booking becomes binding once the Purchaser has received confirmation. If payment is not made within the deadline, the booking will be cancelled. The Purchaser’s payment obligation in such cases of cancellation is governed by section 3.4.

3.3 Prices

The Ski School is responsible for delivering Ski Courses at the prices stated on their website, on Alpinco’s website, in special offers, or in other informational/marketing materials issued by the Ski School or Alpinco.

The Ski School reserves the right for typographical errors and, in such cases, may adjust the booking to the correct price. The Ski School also reserves the right to adjust prices due to increased costs for goods and services, higher taxes and fees, and/or other circumstances beyond their control.

Such adjustments are conditional on the Ski School notifying the Purchaser of the corrected price before the Ski Course begins.

3.4 Cancellation/Changes

Ski Courses may be cancelled or changed (date/time) up to 48 hours before the scheduled start time. For cancellations within the deadline, the full purchase amount will be refunded, less a cancellation fee of NOK 300.

For changes to date or time up to 48 hours before the start, no fee will be charged.

Cancellations or changes may be made in writing to the Ski School’s email address, or orally by appearing at the Ski School’s premises.

No refund is given for cancellations or changes made later than 48 hours before the scheduled start. In such cases, the Purchaser must pay for the Ski Course as originally booked.

If the booking was made with a deferred payment deadline, and payment falls due earlier than 48 hours before the start, failure to pay will be regarded as a cancellation releasing the Purchaser from the obligation to pay, except for the cancellation fee of NOK 300.

Such cancellation will occur automatically the day after the due date. Any new booking by the Purchaser will be subject to these terms, the applicable prices, and the Ski School’s capacity at the time.

If the Ski School is unable to carry out the Ski Course as booked, for example due to injury, illness, or similar of an instructor, the Ski School will offer the Purchaser a course on another date, time, or location. The Purchaser is free to decline, in which case the Purchaser has the right to a refund of the purchase price.

3.5 Right of Withdrawal

Ski Courses are services related to leisure activities, scheduled for a specific date or period. Such purchases do not entitle the Purchaser to a right of withdrawal, cf. Right of Withdrawal Act § 22, first paragraph, letter m.

3.6 Delivery of Ski School Services

3.6.1 General

The Ski School provides instruction in skiing and snowboarding techniques for children from two years of age and older, as well as for adults. Courses are adapted to all levels, from beginners who have never skied before, to advanced adults seeking to improve technique. Courses are offered as group lessons and private lessons.

3.6.2 Group Lessons

Group lessons are available for children from four years of age and older.

All group lessons start on a Monday, and all participants must attend the first day of the course.

Group lessons cover only the instruction service. The Purchaser must ensure that lift passes, equipment, and weather-appropriate clothing are arranged before the start.

Group courses are dependent on sufficient enrolment, and the Ski School reserves the right to merge groups with too few participants. Such merging may affect start times and meeting points, without constituting a breach of contract by the Ski School.

3.6.3 Private Lessons

Private lessons are offered for children from two years and older.

Private lessons are available for one or more persons, but no more than five participants per instructor.

Private lessons cover only the instruction service. All participants must ensure that lift passes, equipment, and weather-appropriate clothing are arranged before the start.

The Ski School recommends that those booking private lessons together ensure that all participants are of the same skill level. Differences in ability may affect the instructor’s focus and the quality of the lessons, without this constituting a breach of contract by the Ski School.

3.7 Participant’s Responsibility

Participants in Ski Courses must comply with the instructions provided by the Ski School’s instructors at all times.

Participants are responsible for using appropriate ski equipment and clothing, including helmets. Helmets are mandatory for all participants under 18 years of age.

The Ski School reserves the right to deny participation if the participant does not have appropriate clothing, equipment, or safety gear. In such cases, the Purchaser will not be entitled to a refund.

Participants must be present at the agreed meeting place and time. The Ski School is not obliged to extend or reschedule courses due to late arrival.

All skiing and participation in Ski Courses is at the participant’s own risk. The participant (or the Purchaser) must ensure that travel insurance covering accidents and injuries is in place.

3.8 Refunds

Refunds will not be provided if a participant cannot attend or complete a Ski Course due to illness, injury, travel delays, or similar personal reasons.

The Purchaser is advised to have travel insurance that covers such situations.

If the Ski School cancels a Ski Course for reasons within its control, the Purchaser is entitled to a full refund of the course fee, or an offer to attend at another time.

No refund is provided if courses cannot be carried out due to weather conditions, operational interruptions at lifts, or other circumstances beyond the Ski School’s control.

3.9 Personal Data

Alpinco and the Ski School are committed to protecting your privacy and process all personal data in accordance with applicable regulations. For more information on our processing of personal data, please see our Privacy Policy in section 7 of this document.

3.10 Dispute Resolution

If you have a complaint, please contact the relevant Ski School directly. If the parties cannot reach agreement, the dispute may be brought before the courts.

This agreement is governed by Norwegian law, with venue in the judicial district where the relevant Destination is located.

4 ALPINCO AS – TERMS AND CONDITIONS FOR BIKE GUIDE

4.1 General

These terms and conditions, together with your confirmed booking, form the contractual basis for your booking of guided bike tours (“Bike Guide”) at one of Alpinco AS’s (Alpinco) bike destinations, Hafjell, Kvitfjell, or Oppdal (“Destinations”).

All guided bike tours at Alpinco’s Destinations are operated by third parties (“Guide Provider”), and Alpinco acts solely as an intermediary of these services. These terms and conditions apply to the relationship between you (the “Participant”) and the relevant Guide Provider.

4.2 Booking and Payment

4.2.1 Completion of Booking

All bookings of Bike Guide services are made via Alpinco’s website www.alpinco.no, or directly through the Guide Provider at one of Alpinco’s Destinations.

The person booking the Bike Guide service (the “Purchaser”) must be at least 18 years of age at the time of booking.

4.2.2 Binding Effect of Booking

The booking becomes binding for the parties as soon as the Purchaser has received a booking confirmation and has paid in accordance with section 4.2.3. For bookings with deferred payment deadlines, the booking becomes binding even if payment has not been completed.

4.2.3 Payment

The Purchaser is obliged to pay the agreed price for the Bike Guide service upon completion of the booking via Alpinco’s website, within the deadline specified in the booking confirmation, or before the service begins, depending on what is stated in the confirmation.

Several payment services are available at Alpinco’s Destinations. By paying, the Purchaser accepts the terms of the applicable payment service.

Transaction costs for international payments shall be borne by the Purchaser.

4.2.4 Delayed Payment

For bookings of Bike Guide services with deferred payment deadlines, the booking becomes binding once the Purchaser has received confirmation. If payment is not made within the deadline, the booking will be cancelled. The Purchaser’s payment obligation in such cases of cancellation is governed by section 4.4.

4.3 Prices

The Guide Provider is responsible for delivering Bike Guide services at the prices stated on their website, on Alpinco’s website, in special offers, or in other informational/marketing materials issued by the Guide Provider or Alpinco.

The Guide Provider reserves the right for typographical errors and, in such cases, may adjust the booking to the correct price. The Guide Provider also reserves the right to adjust prices due to increased costs for goods and services, higher taxes and fees, and/or other circumstances beyond their control.

Such adjustments are conditional on the Guide Provider notifying the Purchaser of the corrected price before the Bike Guide service begins.

4.4 Cancellation/Changes

Bike Guide services may be cancelled or changed (date/time) up to 7 days before the scheduled start time.

For cancellations up to 7 days before the start date, the full purchase amount will be refunded, less a cancellation fee of NOK 300.

For cancellations later than 7 days before the start, but no later than 24 hours before, 50% of the purchase price will be refunded.

For cancellations less than 24 hours before the scheduled start time, no refund will be provided, and the Purchaser is obliged to pay the full amount.

If the booking was made with a deferred payment deadline, and the payment is due earlier than 7 days before the start, failure to pay will be regarded as a cancellation releasing the Purchaser from the obligation to pay, except for the cancellation fee of NOK 300.

Such cancellation will occur automatically the day after the due date. Any new booking by the Purchaser will be subject to these terms, the applicable prices, and the Guide Provider’s capacity at the time.

If the Guide Provider is unable to provide the Bike Guide service as booked, for example due to illness or absence of the guide, the Guide Provider will offer the Purchaser a new date, time, or guide. The Purchaser may decline, in which case they are entitled to a refund of the purchase price.

4.5 Right of Withdrawal

Bike Guide services are leisure activity services, scheduled for a specific date or period. Such purchases do not entitle the Purchaser to a right of withdrawal, cf. Right of Withdrawal Act § 22, first paragraph, letter m.

4.6 Delivery of Bike Guide Services

The Guide Provider offers guided biking tours suitable for various levels, from beginners to advanced participants. The Purchaser is responsible for ensuring that all participants have appropriate equipment, including helmets, and meet the skill level required for the booked service.

If participants fail to meet the required skill or equipment standards, the Guide Provider may refuse participation without this constituting a breach of contract. In such cases, the Purchaser is not entitled to a refund.

4.7 Participant’s Responsibility

Participants are responsible for following all instructions given by the Guide during the tour. Failure to comply may lead to exclusion without a refund.

Participants must use appropriate equipment and safety gear, and helmets are mandatory for all participants.

All biking is undertaken at the participant’s own risk. The participant (or Purchaser) must ensure that travel insurance covering accidents and injuries is in place.

4.8 Refunds

Refunds will not be given if the participant cannot attend or complete the Bike Guide service due to illness, injury, travel delays, or similar personal reasons.

The Purchaser is advised to have travel insurance that covers such situations.

If the Guide Provider cancels a Bike Guide service for reasons within its control, the Purchaser is entitled to a full refund of the fee, or an offer to attend at another time.

No refund is provided if services cannot be carried out due to weather conditions, operational interruptions at lifts, or other circumstances beyond the Guide Provider’s control.

4.9 Personal Data

Alpinco and the Guide Provider are committed to protecting your privacy and process all personal data in accordance with applicable regulations. For more information, please see our Privacy Policy in section 7 of this document.

4.10 Dispute Resolution

If you have a complaint, please contact the relevant Guide Provider directly. If the parties cannot reach agreement, the dispute may be brought before the courts.

This agreement is governed by Norwegian law, with venue in the judicial district where the relevant Destination is located.

5 ALPINCO HOSPITALITY AS – TERMS AND CONDITIONS FOR HOLIDAY HOME RENTALS

5.1 General

These terms and conditions, together with your confirmed booking, form the contractual basis for your rental of a holiday home (“Accommodation”) through Alpinco Hospitality AS (Alpinco Hospitality), whether the property is owned by Alpinco Hospitality or privately owned and rented out via Alpinco Hospitality.

Alpinco Hospitality is responsible for ensuring that the Accommodation is available to the tenant (the “Guest”) in accordance with these terms.

5.2 Booking and Payment

5.2.1 Completion of Booking

Bookings of Accommodation are made via Alpinco’s website www.alpinco.no or via Alpinco’s booking office.

The person booking the Accommodation (the “Purchaser”) must be at least 18 years old at the time of booking.

5.2.2 Binding Effect of Booking

The booking becomes binding for the parties as soon as the Purchaser has received a booking confirmation and has paid in accordance with section 5.2.3. For bookings with deferred payment deadlines, the booking becomes binding even if payment has not yet been completed.

5.2.3 Payment

The Purchaser is obliged to pay the agreed price for the Accommodation within the deadline stated in the booking confirmation.

If a deposit is specified, it must be paid by the stated deadline. The balance must be paid no later than 35 days before arrival, unless otherwise stated in the booking confirmation.

For bookings made later than 35 days before arrival, the full price must be paid immediately.

Several payment services are available. By paying, the Purchaser accepts the terms of the relevant payment service.

5.2.4 Delayed Payment

If the Purchaser fails to pay the deposit or balance by the due date, Alpinco Hospitality may cancel the booking. In such cases, the Purchaser’s payment obligations are governed by section 5.5.

5.3 Prices

Alpinco Hospitality is responsible for ensuring that the Accommodation is available at the prices listed on its website, in special offers, or in other informational/marketing materials.

Alpinco Hospitality reserves the right for typographical errors and, in such cases, may adjust the booking to the correct price. Alpinco Hospitality also reserves the right to adjust prices due to increased costs for goods and services, higher taxes and fees, and/or other circumstances beyond Alpinco Hospitality’s control.

Such adjustments are conditional on Alpinco Hospitality notifying the Purchaser of the corrected price before arrival.

5.4 Guest’s Use of the Accommodation

The Guest must treat the Accommodation, fixtures, and furnishings with due care. The Accommodation must be left tidy and in good condition.

The Guest is liable for damages to the Accommodation and its contents caused by negligence or improper use by the Guest or others in their party.

The Accommodation may only be used by the number of persons specified in the booking confirmation. Subletting is not permitted.

The Guest must follow the house rules applicable to the Accommodation, which are provided in writing or posted in the Accommodation.

5.5 Cancellation

For cancellations made up to 35 days before arrival, a cancellation fee of NOK 500 will be charged.

For cancellations made later than 35 days before arrival, but no later than 7 days before arrival, 50% of the rental price must be paid.

For cancellations made later than 7 days before arrival, the Purchaser is obliged to pay the full rental amount.

If the booking was made with a deferred payment deadline and payment falls due earlier than 35 days before arrival, failure to pay will be regarded as a cancellation releasing the Purchaser from the obligation to pay, except for the cancellation fee of NOK 500. Such cancellation will occur automatically the day after the due date.

If the payment deadline is later than 35 days before arrival, failure to pay will be deemed an unauthorized cancellation and does not release the Purchaser from the obligation to pay.

5.6 Right of Withdrawal

Rental of Accommodation is a service related to leisure activities, scheduled for a specific date or period. Such purchases do not entitle the Purchaser to a right of withdrawal, cf. Right of Withdrawal Act § 22, first paragraph, letter m.

5.7 Delivery of Accommodation

The Guest has the right to use the Accommodation from the time of check-in stated in the booking confirmation, and must vacate the Accommodation by the stated check-out time.

If the Accommodation is not cleaned before check-out, Alpinco Hospitality may charge the Guest for cleaning costs, unless cleaning was included in the booking.

The Guest is obliged to report any damage or defects in the Accommodation immediately to Alpinco Hospitality.

5.8 Complaints and Deficiencies

If the Guest discovers deficiencies in the Accommodation, they must immediately notify Alpinco Hospitality so that corrective measures can be taken.

Failure to report in a timely manner may limit the Guest’s right to a price reduction or compensation.

5.9 Personal Data

Alpinco Hospitality processes personal data in accordance with applicable regulations. For more information, please see section 7 of this document.

5.10 Dispute Resolution

If you have a complaint, please contact Alpinco Hospitality directly. If no agreement is reached, the dispute may be brought before the courts.

6 STANDARD INFORMATION FOR PACKAGE TRAVEL AGREEMENTS

The combination of travel services you are offered constitutes a package travel arrangement under the Package Travel Act.

You are therefore entitled to all rights applicable to package travel under Norwegian law. Alpinco AS/Alpinco Hospitality AS will be fully responsible for ensuring that the entire package is carried out as agreed.

In addition, Alpinco AS/Alpinco Hospitality AS has, by law, a security to refund your payments and, if transport is included, to ensure your repatriation if they become insolvent.

6.1 Main Rights under the Package Travel Act

  • You will receive all essential information about the package before entering into the contract.
  • At least one trader will always be responsible for the proper performance of all travel services included in the contract.
  • You will always be provided with an emergency telephone number or details of a contact point where you can reach the organizer or retailer.
  • You may transfer the package to another person, with reasonable notice and possibly subject to additional costs.
  • The price of the package may only be increased if specific costs increase (e.g., fuel prices), and if expressly provided for in the contract. In any case, price increases are only possible if they exceed 8% of the package price. If the price increase exceeds 8%, you may cancel the contract. If the organizer reserves the right to increase the price, you are entitled to a price reduction if the relevant costs decrease.
  • You may cancel the contract without paying a cancellation fee if extraordinary circumstances occur at the destination or in its immediate vicinity which significantly affect the performance of the package or the transport of passengers to the destination.
  • In addition, you may cancel the contract at any time before the start of the package against payment of an appropriate and justifiable cancellation fee.
  • If significant elements of the package cannot be provided as agreed, you are entitled to other equivalent services without extra cost. You may cancel the contract without paying a cancellation fee if services are not provided in accordance with the contract and this significantly affects the performance of the package and the organizer has not remedied the problem.
  • You are also entitled to a price reduction and/or compensation if the travel services are not performed or are improperly performed.
  • The organizer must provide assistance if you are in difficulty.
  • If the organizer becomes insolvent, payments will be refunded. If the organizer becomes insolvent after the start of the package, and if transport is included in the package, repatriation of passengers is ensured. Alpinco AS/Alpinco Hospitality AS has taken out insolvency protection with (insert name of guarantor/insurance provider). If services are not provided due to insolvency, travelers may contact this entity or, if relevant, the competent authority: (insert name, contact details, and geographical address of the authority/guarantor).

7 DATA STORAGE / PRIVACY POLICY

7.1 General

Alpinco AS and Alpinco Hospitality AS (“Alpinco”) process personal data in connection with bookings of lift passes, equipment rental, ski school, bike guide services, and holiday home rentals.

Alpinco is the data controller for the processing of personal data, unless otherwise expressly stated in connection with services provided by third-party suppliers (e.g., ski school, rental providers, guide providers). In such cases, the third party is the data controller for their processing of your personal data.

7.2 Categories of Personal Data

The following categories of personal data may be processed:

  • Name, address, email, phone number
  • Payment details
  • Date of birth/age group
  • Card number (Axess card)
  • Booking history
  • Information necessary to deliver the services booked

7.3 Purpose of Processing

Personal data is processed for the following purposes:

  • To manage and complete bookings
  • To provide the services you have purchased (e.g., lift passes, rental equipment, ski school, bike guide, accommodation)
  • To handle payment, invoicing, and accounting
  • To provide customer service and respond to inquiries
  • To comply with legal obligations
  • For analysis and improvement of services (in anonymised or aggregated form)

7.4 Legal Basis

The processing of personal data is based on:

  • Performance of a contract with you (GDPR art. 6(1)(b))
  • Compliance with legal obligations (GDPR art. 6(1)(c))
  • Legitimate interests, such as improving services and preventing fraud (GDPR art. 6(1)(f))
  • Consent, where applicable (GDPR art. 6(1)(a))

7.5 Storage Period

Alpinco stores personal data only as long as necessary to fulfil the purposes described above, or as long as required by applicable law (e.g., accounting legislation).

7.6 Disclosure of Personal Data

Personal data may be disclosed to third parties providing services to Alpinco, such as IT service providers, payment providers, and suppliers (ski school, rental, guide providers).

Such third parties only process personal data on behalf of Alpinco and in accordance with data processing agreements.

7.7 Your Rights

You have the right to request access to your personal data, correction of incorrect data, deletion, restriction of processing, and data portability, in accordance with GDPR.

You may also object to processing carried out under legitimate interests, and withdraw consent where processing is based on consent.

7.8 Security

Alpinco implements appropriate technical and organizational measures to ensure that your personal data is processed securely and protected against unauthorized access, alteration, or loss.

7.9 Complaints

If you believe that Alpinco’s processing of personal data does not comply with applicable legislation, you may lodge a complaint with the Norwegian Data Protection Authority (Datatilsynet).
